Subj: Legal Team Update - FOIA Minneapolis

Freedom of Information Act (FOIA) Action: Minneapolis

On March 21st, Judge Donovan W. Frank issued an Order
& Memorandum regarding the appeal the Legal Team filed
concerning the Magistrate Judge Decision in our
Minneapolis FOIA action. The Court set the matter for oral
argument.
As you may recall, we argued that the Federal Bureau of
Investigation (FBI) has not acted in good faith as regards the
release of approximately 90,000 pages still withheld by the
Bureau's Minneapolis Field Office.
A hearing will be held (date to be determined) to examine the
procedural status of this case.
It should be noted that the judge mentioned the availability of the
Peltier trial transcript to the defense team & prosecutors, i.e., that
transcripts were released daily during the trial & a full transcript
(24 volumes) was released to both sides following the trial. The
trial transcript is a matter of public record not one page of which
was sealed. Yet, at the end of 2004, the FBI chose to release
said transcript so as to appear to be in compliance with the
District Court's order to release documents to Leonard Peltier &
his attorneys.
